Terms of Service
PLEASE READ THESE TERMS CAREFULLY. They are a binding legal agreement between you and Carlinks ("we", "us", "our", "Carlinks Verify"). By accessing or using the Service (defined below) you confirm that you have read, understood, and agreed to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Definitions
- "Service" means the Carlinks Verify website at https://carlinks.xyz, any successor or related domains, the forthcoming Carlinks Verify mobile application(s) for iOS and Android (see §4), any application programming interfaces (APIs) we make available, and all features, content, reports, and downloads associated with the foregoing.
- "User", "You", "Your" means any individual or entity accessing or using the Service, including unregistered visitors and paying customers.
- "Report" means the paid auction-sheet verification report we deliver (digital PDF / on-screen page) following a successful chassis lookup.
- "Content" means all text, data, images, graphics, code, layouts, documents, reports, and other material made available through the Service.
- "Payment Processor" means SSLCommerz Bangladesh Ltd, our licensed payment-gateway partner, or any successor processor we engage.
- "Effective Date" means the date shown at the top of these Terms.
2. Agreement & acceptance
These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and us regarding the Service. Your acceptance is signified by any of: (a) accessing the Service; (b) clicking an "I agree" or equivalent control during checkout; or (c) completing a paid purchase. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "You" refers to that organisation.
3. Description of the Service
Carlinks Verify is a digital verification service. We look up the original auction-house record of a Japanese used vehicle using its chassis (frame) number and return:
- Free preview — make, model, year, displacement, grade, color and sale status. No payment required. Anonymous use allowed.
- Paid full Report — the complete auction inspector sheet (where available from the source auction archive): accident map, mileage at auction, repair marks, scratch / dent / paint / rust notations, interior grade, equipment list, and inspector remarks. Standard price: ৳800 BDT per chassis (price subject to change; the on-screen price at checkout is authoritative for each transaction).
- Free duty-calculator tool at /duty-calculator — informational only.
The Service is provided over the public Internet. We do not guarantee that every chassis will return a result, that the Report will be complete for every record, or that historical auction archives will remain available indefinitely.
4. Mobile applications — coming soon
We are developing native mobile applications for iOS (App Store) and Android (Google Play) that will provide the same chassis-verification features as the web Service, plus offline access to your past Reports and push-notification delivery for asynchronous fulfilment. The apps have not yet launched. When released:
- These Terms (and the linked Privacy Policy) will apply to your use of the apps in addition to the platform-specific terms imposed by Apple Inc. or Google LLC.
- You agree that Apple / Google are intended third-party beneficiaries of these Terms with respect to the iOS / Android app respectively and may enforce them as such.
- App permissions (notifications, camera for chassis-plate OCR, storage for cached Reports) will be requested only on first use and may be revoked at any time in your device settings — see our Privacy Policy.
- Pre-launch sign-up forms (if offered) merely register interest; they do not create any contractual right to access the apps at any specific date.
5. Eligibility
To use the paid Service you must (i) be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher; (ii) have legal capacity to enter a binding contract under the laws of Bangladesh or your local jurisdiction; (iii) not be a person barred from receiving the Service under applicable export, sanctions, or anti-money-laundering laws; and (iv) not have been previously suspended or removed from the Service.
6. Accounts & identity (when applicable)
Anonymous chassis search is permitted. When you place a paid order, we require an accurate full name, valid email address, and Bangladesh mobile number (or international equivalent) for receipt, delivery, and fraud-prevention purposes. You are responsible for keeping any account credentials (when accounts launch) confidential and for all activity under your account. Submitting false, stolen, or impersonated identity information is a material breach of these Terms and grounds for order cancellation without refund and permanent suspension.
7. Pricing, payment & taxes
All prices are displayed in Bangladeshi Taka (BDT). The price shown at checkout is the final price you will be charged, inclusive of applicable Bangladesh VAT where charged. Payments are processed exclusively by our Payment Processor (SSLCommerz). We do not see, collect, transmit, or store your full card number, CVV, PIN, or one-time passwords (OTPs). Accepted methods include Visa, Mastercard, American Express, bKash, Nagad, Rocket, Upay, and online bank transfer (subject to your bank's support and SSLCommerz availability). You authorise us to charge your selected payment method for the amount displayed at checkout. Currency conversion (if any) is performed by your card-issuing bank or wallet provider at their then-current rate.
8. Refunds & cancellations
The Service is a digital service that is delivered immediately upon successful payment. Refund eligibility, the request process, and processing timelines are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.
9. Acceptable use
You agree to use the Service only for its intended purpose — verifying vehicles you or your customers are evaluating for a bona-fide purchase. You will comply with all applicable laws and respect the rights of other users.
10. Prohibited activities
You will not, and will not permit any third party to:
- Use automated tools, bots, scrapers, crawlers, headless browsers, or any other programmatic means to access the Service without our prior written authorisation (B2B API access is available — contact us);
- Resell, sublicense, redistribute, repackage, or commercially exploit any Report or the Content (including republishing on third-party "auction-sheet" services);
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code from any part of the Service;
- Circumvent, disable, or otherwise interfere with security features, rate limits, bot challenges, encryption, watermarks, or payment controls;
- Use stolen, fraudulent, expired, or unauthorised payment instruments, or commit any form of payment fraud or chargeback abuse;
- Submit chassis numbers that you know to be fabricated solely to probe the archive;
- Impersonate any person or misrepresent your affiliation with any person or entity;
- Upload or transmit viruses, worms, ransomware, or any other malicious code;
- Use the Service in violation of applicable export-control or sanctions laws;
- Harass, threaten, or abuse our staff, support agents, or other users;
- Use the Service in a way that imposes a disproportionate load on our infrastructure or that of our partners.
11. Intellectual property
The Service, including the Carlinks Verify brand, logos, designs, software, source code, databases, documentation, and the look-and-feel, is the exclusive property of Carlinks or its licensors and is protected by Bangladeshi and international copyright, trademark, trade-secret and other intellectual-property laws. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service and to print or download a single copy of a paid Report for your own internal evaluation of the specific vehicle covered by that Report. All other rights are reserved.
Auction-sheet data is the property of its respective auction house (USS, JU, TAA, HAA, CAA, Aucnet, Arai and others) or their licensees. We redistribute that data under permitted-use terms with our upstream data partners. You acquire no ownership of any auction record by purchasing a Report.
12. User content & feedback
If you submit feedback, suggestions, ideas, or bug reports ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, and incorporate that Feedback into the Service without obligation or attribution to you. Do not submit confidential information as Feedback.
13. Privacy
Our collection, use, storage, and sharing of personal information is governed by our Privacy Policy. By using the Service you acknowledge and consent to the data practices described there.
14. Data accuracy & disclaimer
We obtain auction-sheet data from independent third-party auction archives. While we make commercially reasonable efforts to deliver accurate, unmodified data, we make no warranty that any Report is complete, error-free, or up-to-date. A Report reflects the state of the vehicle at the moment of auction; it does not reflect post-auction repair, modification, accident, or odometer tampering. Do not rely on a Report as the sole basis for a purchasing decision. Always conduct a physical inspection (or commission a qualified inspector) before committing funds. We accept no responsibility for purchasing decisions made based on Report data.
15. Third-party services & links
The Service integrates with third-party services (SSLCommerz, our hosting/edge provider, our bot-protection provider, our email-delivery provider, and the upstream auction-data provider). Your use of those services may be subject to their own terms. We are not responsible for the content, policies, or practices of any third-party site linked from the Service, including app-store listings, social-media properties, or external news articles.
16. Modification & availability of the Service
We may modify, suspend, or discontinue any feature of the Service (including the mobile applications, the API, or specific auction-archive integrations) at any time without liability. We use commercially reasonable efforts to provide a 24×7 service, but we do not guarantee uninterrupted availability. Scheduled maintenance, force-majeure events, and upstream outages can interrupt the Service.
17. Termination & suspension
We may suspend or terminate your access immediately, without prior notice or refund, for any breach of these Terms, suspected fraud, abusive behaviour, chargeback initiation without contacting us first, or for any reason at our reasonable discretion. You may stop using the Service at any time. Sections that by their nature should survive termination (including §10, §11, §14, §18, §19, §20, §22, and §23) will survive.
18. Disclaimers (AS IS / AS AVAILABLE)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NO ADVICE OR INFORMATION OBTAINED FROM US CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CARLINKS, ITS DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR USE OR INABILITY TO USE THE SERVICE; (b) THE COST OF SUBSTITUTE GOODS OR SERVICES; (c) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS; OR (d) ANY OTHER MATTER RELATING TO THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, IS LIMITED TO THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) BDT 5,000. The foregoing limitations apply notwithstanding the failure of essential purpose of any limited remedy.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, death, or personal injury caused by negligence.
20. Indemnification
You agree to defend, indemnify, and hold harmless Carlinks, its directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any intellectual-property or privacy right; or (d) any claim that your use of the Service caused damage to a third party.
21. Force majeure
Neither party will be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, floods, fire, civil unrest, war, terrorism, government action, hartal, internet or telecommunications outages, third-party platform failures (cloud, payment processor, or auction-data provider), or labour disputes.
22. Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The parties submit to the exclusive jurisdiction of the competent courts located in Dhaka, Bangladesh for the resolution of any dispute, controversy, or claim arising out of or relating to these Terms or the Service. Before filing any claim, the parties agree to attempt good-faith resolution by email for at least thirty (30) days.
23. Notices
We may give notice to you by email (to the address on file with your order), by in-Service banner, or by posting to https://carlinks.xyz. You give notice to us by email to hello@carlinks.xyz, with a hard-copy duplicate to our registered address if the matter is legally material.
24. Changes to these Terms
We may revise these Terms from time to time. The "Effective Date" at the top is updated when we do. Material changes will be highlighted (in a banner, an email to recent customers, or both). Your continued use of the Service after the Effective Date of a revised version constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
25. Severability & waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be modified only to the extent necessary to make it valid, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
26. Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder, in whole or in part, without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets, on notice to you.
27. Entire agreement
These Terms, together with the documents incorporated by reference (Privacy Policy and Return & Refund Policy), constitute the entire agreement between you and us regarding the Service and supersede any prior or contemporaneous agreements, communications, or understandings.
